Hot Tub Policy
Overview The purpose of the Hot Tub Policy is to maintain a
favorable appearance and safe surrounding for the resident and nearby neighbors
in the River Pines development through an approval process for the placement,
installation on common elements and to assure the structural integrity of the
location site of the hot tub.
The Board of Directors reserves the right to review each request on an
individual basis and to adjust requirements in order to assure the aesthetic
appearance and safety for residents. Policy Procedures The board will
allow a co-owner who wishes to install a hot tub on a common element to do so
based on the following guidelines.
Application Process Prior to installation, the co-owner will
present the following in writing to the Architectural Committee for approval:
- The location of the hot tub
- The size of the hot tub
- Specifications for installation by the manufacturer
- Specifications for installation by the installer
- The location for entry for any wiring or water line
Installation Process
Residents
must adhere to the regulations for installation of a hot tub listed below:
- Licensed and insured tradesmen in accordance with all applicable City,
State and Federal codes, laws, ordinances and regulations shall perform all
work.
- The deck itself must be reinforced to enable it to carry the additional
weight.
- All electrical installations or wiring in connection with the hot tub
must conform to the National Electrical Code. (Code 1981-23.080)
- The hot tub shall be completely enclosed by fencing (deck railing) not
less than four (4) feet from the ground. If the deck has any steps, a gate
is required and must be of a self-latching type with the latch on the inside
of the gate. The gate must be capable of being securely locked when the hot
tub is not in use.
- The hot tub must have a lid with a key lock and the lid must be locked
when the tub is not being used.
Additional Requirements Residents must adhere to the
following requirements:
- Approval of neighbors on either side of their unit
- The commons area where the hot tub is located must be aesthetically
maintained at all times
- Prohibited activities according to the Condominium By-laws, Article
VI, Section 4 are as follows:
“No immoral, improper, unlawful or offensive activity shall be carried on
in any Unit or upon the Common Elements, Limited or General, nor shall
anything be done which may be or become an annoyance or a nuisance to the
Co-owners of the Condominium, nor shall any unreasonable noise activity be
carried on in any Unit or on the Common Elements.”
- Any time the hot tub needs to be drained, it must not be emptied onto
the grounds. The waterline must go directly into a sewer for drainage.
- An umbrella insurance policy for liability in the sum of one (1)
million dollars minimum must be submitted. When applying for the umbrella
policy, the co-owner must inform
the issuing company that notification from the insurance company
confirming the coverage or termination of coverage, that a minimum amount
of one million dollars is in the coverage, and the term of the policy must
be sent to:

The insurance company must be informed that they will furnish the Board a
confirmation of the above at each renewal date.
- The co-owner is required to fill out a Modification Request form prior
to final approval. This form transfers all costs for maintenance, repair
and replacement of the hot tub and surrounding area to the co-owner.
- The co-owner will be responsible for any fee for the processing and
recording of the Modification Request form by the Association legal
counsel.
